Is a UK Lasting Power of Attorney Valid Abroad?

Many clients assume that once a UK Lasting Power of Attorney (LPA) has been registered, it can automatically be used anywhere in the world. Unfortunately, that is not always the case.

Whether a UK LPA will be accepted overseas depends on the law and practice of the country where it is being presented — and sometimes on the specific requirements of the bank, land registry or institution involved.

Why Recognition Abroad Is Not Automatic

A UK LPA is created under the Mental Capacity Act 2005 and must be registered with the Office of the Public Guardian before it can be used. It is fundamentally a UK domestic legal document.

Some countries follow an international agreement known as the Hague Convention on the International Protection of Adults, which provides a framework for recognising powers of attorney between member states.

However:

  • Not all countries are members of the Convention.
  • Some countries with significant UK expatriate communities are not participating states.
  • Even where a country is a member, local implementation and institutional practice can vary.
  • Banks and financial institutions often apply their own internal policies.
  • England and Wales has not ratified the Convention.

If the country concerned is not part of the Convention, there is no automatic obligation for it to recognise a UK LPA.

How an LPA Is Prepared for Overseas Use

An apostille cannot simply be attached directly to a registered Lasting Power of Attorney.

Before an LPA can be submitted for apostille, it must first be properly authenticated by a Notary Public.

The process involves:

  • Verifying that the LPA is a genuine registered document (or properly certified copy).
  • Preparing a formal notarial certificate confirming its authenticity.
  • Applying the notary’s official signature and seal.
  • Submitting the notarised document to the Foreign, Commonwealth & Development Office for the issue of an apostille.

The apostille does not confirm that the powers granted under the LPA will be recognised overseas. Rather, it verifies the authenticity of the notary’s signature and seal so that the document can be presented internationally.

In practice, many overseas banks, land registries and institutions will accept a properly notarised and apostilled LPA. However, requirements vary significantly between jurisdictions and even between individual organisations.
